Understanding Strict Liability Vs. Negligence In Asbestos Lawsuits
At Savinis, Kane, & Gallucci, L.L.C., we are proud of our record of verdicts and settlements on behalf of clients who have been injured or who have lost loved ones due to asbestos exposure. With more than 60 years of combined experience, our Pittsburgh asbestos claims attorneys have represented victims of lung cancer, mesothelioma and numerous other asbestos-related diseases.
When our Pennsylvania law firm tries an asbestos lawsuit, we can try it under negligence or under strict liability. Here’s the difference:
- Negligence: You must be able to show that the defendant (usually the asbestos manufacturer or distributor) knew or should have known about the hazard, but failed to take appropriate action to guard against it. If you developed cancer from working on a company’s premises, for instance, we may try the case under negligence.
- Strict liability: You must prove that the defendant manufactured a defective product that resulted in harm. In these cases, it does not matter if the company knew about the danger. If you were injured by exposure to an asbestos-containing product, we may try the case under strict liability.
Depending upon the circumstances, our lawyers may have the option to try your case under both options at the same time.
Preparing Every Case For The Possibility Of Trial
At Savinis, Kane, & Gallucci, L.L.C., we are more than willing to settle a case instead of taking it to trial, if settling is in the best interest of our client. However, we prepare every case with the understanding that it may require litigation. If so, our attorneys have the tenacity and skill to present compelling arguments before judge and jury.
