How to prove negligence in a case of PA nursing home abuse?

On behalf of Savinis, Kane, & Gallucci, L.L.C. | Jan 23, 2016 | Nursing Home Deaths

The elderly are some of the most respected members of society in that they have seen and endured things the younger generations never have and never will. Their wisdom has come from many years of experience. This is why it makes it so hard to hear about cases in which the elderly have suffered nursing home abuse or neglect in Pittsburgh. There are ways that this can be proven in a court of law.

One method of proving nursing home abuse or neglect is by proving negligence on behalf of the nursing home facility, staff or affiliated third-party. Negligence means that ‘but for’ a nursing home’s actions or inactions the nursing home resident would not have been harmed. Naturally older people are occasionally subjected to behaviors that harm their health, wellbeing or even can cause nursing home death. If an injured party can prove the nursing home’s owner or employees breached a duty of care owed to the injured person, that the person’s injury was caused by this breach and that the nursing home owner’s or employee’s conduct caused the injury, they may be able to recoup losses resulting from the injury.

The financial implications of a bodily injury sustained to a Pittsburgh nursing home resident can be catastrophic. It can potentially damage an elderly person’s quality of life and create thousands in medical expenses related to the injuries. Because of this, injured elderly persons and their families may be looking for reparation. This who have committed a negligent act should be held accountable in order to right their wrongs and to potentially prevent a similar incident from happening to someone else in the future.

While there is no way to ascertain what the potential financial recovery could be in specific cases at a glance, it is always best to err on the side of caution. Ensuring that a loved one’s health is in the best condition it could be is one of the most important things. Sometimes the expenses related to medical can hold people back from achieving top-notch care. Do not allow anything to stand in your way if your family has been the victim of nursing home abuse or neglect.
