Moving toward recovery after the death of a loved one

On behalf of Savinis, Kane, & Gallucci, L.L.C. | Sep 27, 2015 | Work-Related Deaths

The loss of a loved one is almost always a tragic experience. It can be even more tragic when that loss occurs in an environment that is, for all practical purposes, meant to be safe. The families left behind after a loved one has passed away due to a work incident often have a large burden to carry. This burden may be the driving force behind many families’ decision to seek reparations for their loved one’s untimely death.

What a family may be looking to do after a loved one’s death connected to a work related injury is to consider how this death fits into a wrongful death suit. The premise of a work-related injury death is negligence. This means that a workplace was somehow responsible for the death of an employee because they failed to uphold a certain standard of care. Negligence is important to wrongful death cases because it is the basis for which guilt is found.

The particular circumstances of the work site and the act preformed by the employee under the employers care are all details that can affect how the case may be viewed. Investigation of the incident is critical to obtaining hard evidence that can prove or disprove the involvement of supposed negligent parties. It is true that many cases like this never make it to trial for one reason or another, but at Savinis Damico & Kane LLC, we believe in preparing for all possible scenarios.

If any of these situations sound familiar to you or a loved one, then it may be worthwhile to look into it. A negligent part may have to pay for lost wages of the loved one or pain and suffering among other things. This is likely very devastating time for the family and proving responsibility for a loved one’s death may be furthest from your mind. However, seeking proper legal assistance can help move through the stress and trauma toward a more comfortable recovery.
