Asbestos and Disease

Pennsylvania Asbestos Lawyers

Asbestos exposure has been shown to cause a long list of deadly diseases, including lung cancer, colon cancer, asbestosis, and the always-fatal mesothelioma.

A Deadly History

The link between asbestos and cancer became apparent as early as the 1930s. Yet, the material continued to be used in a wide range of products, including insulation, fire-retardant materials, gloves, blankets, gaskets, floor tiles, packing materials, cement, shingles, and other products. When regulation of asbestos products began in the 1970s, its widespread use declined. Brake pads, however, contained asbestos as recently as the 1990s.

Long Latency Period

Asbestos fibers can stay within the body for decades. People who are exposed to asbestos often don't develop symptoms of disease for 30 to 50 years. Many people who are diagnosed with asbestos-related diseases today may not even remember being exposed to asbestos years ago.

"OSHA is aware of no instance in which exposure to a toxic substance has more clearly demonstrated detrimental health effects on humans than has asbestos exposure."

Occupational Health and Safety Administration
Rules and Regulations, June 20, 1986

Victims of asbestos-related diseases and their families have a right to claim compensation for medical care, pain and suffering, and lost wages. They may also have a right to punitive damages based on two criteria:

1. Companies that used asbestos were often aware of its dangers, yet failed to warn users and bystanders or make any safety accommodations.

2. The asbestos products were dangerous and defective products that caused serious personal injuries to untold thousands of people across Pennsylvania and throughout the nation. There is a law in Pennsylvania, called strict liability law, which allows Pennsylvania residents to recover monetary damages against manufacturers and suppliers who sold defective products, such as asbestos products, that caused injury to Pennsylvania residents.
